Legal regulation of partnership relations03.02.2012

A meeting of the Ombudsman with the Commission for Human Rights and Public Affairs of the Parliament of the Republic of Latvia and with representatives of non-governmental organizations was held in May 2011 with the view to familiarize with the Strategies of Ombudsman for the years 2011-2013. The Commission for Human Rights and Public Affairs of the Parliament urged the Ombudsman to pay attention to the legal regulation of partnership relations, in addition to the priorities set in the Strategies.more

The Strategy of Ombudsman for the years 2011 – 2013 has been drafted by joint efforts of the team of Ombudsman’s Office to set three goals: The 1st goal: Informed society and timely prevented infringements; The 2nd goal: Observation of the principle of good governance; The 3rd goal: Effectiveness and authority of the Ombudsman. Activities of the Ombudsman’s Office are focused on 6 areas: the rights of children; good governance; civil and political rights; social and economical rights; criminal law; and preventing of discrimination. Priorities are set in each of the above-listed areas, and their implementation is expected by 2013. more

Legal status of non-citizens 02.02.2012

The different legal ties of citizens and non-citizens with the Republic of Latvia determine the different scope of rights (the right to election; the right to hold offices in public service, etc.). The principle of equality permits and even requires different treatment of individuals in different conditions . Therefore, the different scope of rights granted to citizens and non-citizens of the Republic of Latvia may not be qualified as discriminating.more

The Latvian ombudsman, Roman Apsitis learned the 80 differences into the rights of the Latvian citizens and not-citizens. The Latvian ombudsman, Roman Apsitis informed the fraction For Human Rights in United Latvia the results of the case closed on September 30th, which was brought up because of the 80 differences into the rights of the citizens and not-citizens of Latvia. The ombudsmen recognized the line of the differences not having the legitimate aims, are disproportionate and consequently have to be abolished, also have to be replaced with the security rules. The ombudsman demands to abolish the contender status of the permanent resident of EU for the not-citizens and examine of the Latvian language – NovoNews has reported by the Praty. After the citizens of EU got the right of making the real estate deals, the same limitations lost the legitimate aims fro not-citizens. Not-citizens have much bigger connection to Latvia, then the citizens of EU – the ombudsman claims. Apsitis demands form the Government to give the not-citizens the same rights as the EU citizens will receive on the Latvian territory. There is nothing like this has happened in Latvia yet. At the same time, Apsitis admits that removal of the not-citizens from the municipality elections is legitimate, confirming this with the opinion that in this case they will lose the stimulus to became the citizens of the Country. However, all the international instances recommend Latvia to abolish the groundless limitations of the non-citizens, with the naturalization process at the same time. Verdict of the Ombudsman does not mean that the abolishment of the limitations will be concluded. For Human Rights in United Latvia aims to support the Ombudsman and to sue again in case of need.
